In this paper, I offer an immanent critique of John Rawls’s theory of justice which seeks to show that Rawls’s understanding of his theory of justice as criteriological and contractarian is ultimately incompatible with his claim that the theory is grounded on the primacy of the practical. I agree with Michael Sandel’s observation that the Rawlsian theory of justice rests on substantive metaphysical and epistemological claims, in spite of Rawls’s assurances to the contrary. But while Sandel argues (...) for even more substantive metaphysical and epistemological commitments, I argue in the opposite direction. Following J. G. Fichte, I argue for a normative theory of society, not based on some particular notion of the good or on some contentious account of what all reasonable persons would agree to, but based only on the radical primacy of the practical, that is, based only on the seemingly empty premise that free beings - precisely because they are free - cannot be imagined in advance as all agreeing to any particular thing at all. In recent years Michael Sandel’s communitarian criticism of John Rawls’s theory of justice has gained much attention in philosophical circles. Specifically, he takes issue with the conception of the self—implicit in Rawls’s “veil of ignorance”: an extraction of the individual from their social environment, which creates an “unencumbered self” that is then used to theorize about justice. Sandel believes that some social ties are so deeply embedded in the human experience that even hypothetical isolation of the individual (...) is likely to lead ethical thinking astray. A common epistemological assumption in contemporary bioethics held b y both proponents and critics of non-traditional forms of cognitive enhancement is that cognitive enhancement aims at the facilitation of the accumulation of human knowledge. This paper does three central things. First, drawing from recent work in epistemology, a rival account of cognitive enhancement, framed in terms of the notion of cognitive achievement rather than knowledge, is proposed. Second, we outline and respond to an axiological objection to our proposal that draws (...) from recent work by Leon Kass (2004), Michael Sandel (2009), and John Harris (2011) to the effect that ‘enhanced’ cognitive achievements are (by effectively removing obstacles to success) not worthy of pursuit, or are otherwise ‘trivial’. Third, we show how the cognitive achievement account of cognitive enhancement proposed here fits snugly with recent active externalist approaches (e.g., extended cognition) in the philosophy of mind and cognitive science. James Stacey Taylor urges academics to become qualitatively better at what we do in terms of scholarship. For while it will inevitably slow down our rush to publish our work for financial or careerist gains, the quality of published research will improve significantly as a result.In Part I, Taylor focuses on some details of a few salient philosophical discussions concerning the moral limits of markets, including the discussion of the Asymmetry Thesis—that there are some things that can legitimately be given (...) away, but which it would necessarily be wrongful to buy or sell—and how, among others, Michael Sandel's, Debra Satz's, and Elizabeth Anderson's respective works in the field have been misunderstood due to poor scholarship. This mis-ascription has caused confusion in the philosophical literature on markets and morals. As a result, Taylor argues, some scholars misattribute to these authors a view which ‘almost nobody holds’ (p. 29).In Part II, Taylor seeks to remedy the problem of poor scholarship as it ‘derails’ productive philosophical discussion: Higher educational research ought not to answer to market demands, but instead ought to answer to academic ones. Against Individualism: A Confucian Rethinking of the Foundations of Morality, Politics, Family, and Religion presents Henry Rosemont’s reflection on possible Confucian-based avenues for considering solutions to contemporary moral, political, and spiritual problems. Rosemont contends that the ideologies of capitalist economies, which are based largely on competition, and belief in autonomous individuality, including abstract notions of human rights, are fundamentally unable to deal effectively with many of today’s most pressing issues. For example, he argues against appealing to universalist principles in an (...) attempt to dissolve ethical and political tensions between cultures and states. In accordance with this orientation, his work is then best judged on the contributions it makes to constructing new perspectives on the problems addressed rather than how accurately he represents any tradition. In fact, Rosemont readily admits that he may be “unfair” to individualism or “creative[ly] misreading” early Confucianism. In this review article, I will argue that some of the differences Rosemont finds between his Confucian critique of individualism and the communitarian critique of individualism are, in fact, not all that dissimilar. For example, while Rosemont sees Alasdair MacIntyre and Michael Sandel as “individualists,” the general orientation of their communitarian response to libertarianism shares much in common with the Confucian “role ethics” perspective on the person and morality or ethics. In this way, I will argue that while Confucian role ethics and communitarian perspectives certainly have their respective emphases, they also have a lot to offer one another. (shrink)

Inspired by a 1988 trip to El Salvador, Michael J. Perry's new book is a personal and scholarly exploration of the idea of human rights. Perry is one of our nation's leading authorities on the relation of morality, including religious morality, to politics and law. He seeks, in this book, to disentangle the complex idea of human rights by way of four probing and interrelated essays. * The initial essay, which is animated by Perry's skepticism about the capacity of (...) any secular morality to offer a coherent account of the idea of human rights, suggests that the first part of the idea of human rights--the premise that every human being is "sacred" or "inviolable"--is inescapably religious. * Responding to recent criticism of "rights talk", Perry explicates, in his second essay, the meaning and value of talk about human rights. * In his third essay, Perry asks a fundamental question about human rights: Are they universal? In addressing this question, he disaggregates and criticizes several different varieties of "moral relativism" and then considers the implications of these different relativist positions for claims about human rights. * Perry turns to another fundamental question about human rights in his final essay: Are they absolute? He concludes that even if no human rights, understood as moral rights, are absolute or unconditional, some human rights, understood as international legal rights, are--and indeed, should be--absolute. In the introduction, Perry writes: "Of all the influential--indeed, formative--moral ideas to take center stage in the twentieth century, like democracy and socialism, the idea of human rights is, for many, the most difficult. It is the most difficult in the sense that it is, for many, the hardest of the great moral ideas to integrate, the hardest to square, with the reigning intellectual assumptions of the age, especially what Bernard Williams has called 'Nietzsche's thought': 'There is not only no God, but no metaphysical order of any kind....' For those who accept 'Nietzsche's thought', can the idea of human rights possibly be more than a kind of aesthetic preference? In a culture in which it was widely believed that there is no God or metaphysical order of any kind, on what basis, if any, could the idea of human rights long survive?" Authors from the twelfth to the sixteenth centuries defended recognizable principles of toleration. Some scholars have objected that ideas of tolerance originating during the European Middle Ages are irrelevant to modern theories of toleration. The present paper, building upon Michael Sandel’s concept of “judgmental toleration,” demonstrates the applicability of medieval tolerance in modern contexts. The essay initially surveys examples of the deployment of “judgmental toleration” during the Middle Ages in the writings of St. Thomas Aquinas, Nicole Oresme, St. (...) Augustine, Christine de Pizan, Francisco Suárez, and Bartolomé de Las Casas. Thereafter, the paper considers how “judgmental toleration” may prove useful in solving problems that arise in modern theories of tolerance, as reflected in the classical liberalism of John Stuart Mill and in deliberative democratic thought. At the heart of ethics reside the concepts of good and bad; they are at work when we assess whether a person is virtuous or vicious, an act right or wrong, a decision defensible or indefensible, a goal desirable or undesirable. But there are many varieties of goodness and badness. At their core lie intrinsic goodness and badness, the sort of value that something has for its own sake. It is in virtue of intrinsic value that other types of value (...) may be understood, and hence that we can begin to come to terms with questions of virtue and vice, right and wrong, and so on. This book investigates the nature of intrinsic value: just what it is for something to be valuable for its own sake, just what sort of thing can have such value, just how such a value is to be computed. In the final chapter, the fruits of this investigation are applied to a discussion of pleasure, pain, and displeasure and also of moral virtue and vice, in order to determine just what value lies within these phenomena. There is a global consensus of ethicists, politicians, physicians, and international documents that reject any sort of market in human organs. Indeed, this issue has received much attention in the literature in the past few decades, with the majority of commentators placing a high correlation between the sale of organs and financial exploitation. While this argument may be tenable, this analysis seeks to draw out further implications of organ sale, including the idea of moralistic exploitation and the concept that providing (...) a market in a nonmarket good may crowd out certain morals that we should care about. This article will initially discuss the issue of moralistic exploitation, drawing implications from the 2005 UNESCO Declaration on Bioethics and Human Rights and will conclude with applying Michael Sandel’s concept that markets crowd out morals to the issue of organ markets. The past few years have seen a dramatic backlash against identity politics from academics such as Michael Sandel, Kwame Appiah, Mark Lilla, and Francis Fukuyama. In the vocabulary of identity conceptions, we can classify this as a reaction to a growing dissatisfaction with the perceived hollowness and ineffectiveness of “authenticity” that calls for a return to “sincerity”—or a “Political New Sincerity.” We argue that a third identity paradigm is in play as well, namely “profilicity.” This profile-based approach to (...) understanding oneself, others, and the world has had a major impact on social and political life, and yet has gone largely unnoticed or otherwise been mis-diagnosed. This book offers a broad-based study of Jonathan Edwards as a religious thinker. Much attention has been given to Edwards in relation to his Puritan and Calvinist forebears. McClymond, however, examines Edwards in relation to his eighteenth-century intellectual context.
